Terms of service

1. Agreement
By using any service provided by Fast Flow Tech ("we", "us", "our") - the fastflow.tech website, FlowPrime and every product in the Fast Flow Tech ecosystem (together, the "Service") - you agree to be bound by these Terms of Service.
If you use the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
If you do not agree with these Terms, do not use the Service.
2. What the Service is
Fast Flow Tech provides a set of SaaS products reachable through individual subscriptions or through the FlowPrime bundle. The products run on shared infrastructure, including identity (ALKEYON), billing, analytics and hosting.
Each subscriber ("Customer") gets isolated databases within that shared infrastructure. Databases are isolated; compute (CPU, memory) and network bandwidth are shared across tenants.
3. The build program
Separately from the subscription, we run a program in which we build a product for a selected applicant. These terms apply to it:
- Selection: Applying does not create any obligation on either side. We read every application and contact only the ones we select. Selection is at our discretion and no reason has to be given.
- What we charge: We do not charge a development fee for a selected product. What you pay is the FlowPrime subscription for the platform the product is built on and runs on, at the price published on the pricing page.
- Scope and deadline: The scope is agreed in writing at the start, sized to fit the agreed window (one to three months). Anything beyond the agreed scope is a new conversation, not an automatic extension.
- Code ownership: The application code we write for your product belongs to you, from the first day and in writing. It does not include the FlowPrime platform itself, which stays ours and which you use through the subscription.
- Dependency on the subscription: The product runs on FlowPrime. If the subscription ends, we stop hosting the product. Your code remains yours and is handed over.
- No minimum term: There is no minimum term, no penalty and no automatic renewal beyond the ordinary monthly subscription cycle.
4. Accounts
- You must give accurate and complete information when you create an account.
- You are responsible for keeping your credentials confidential.
- You are responsible for everything that happens under your account.
- You must tell us immediately about any unauthorised use of your account.
- You must be at least 16 years old to use the Service.
5. Subscription and billing
5.1 Plans and prices
The Service is sold as paid subscriptions, including FlowPrime (access to every product) and individual product subscriptions. Current prices are on the pricing page.
5.2 Payment
Payments are processed through Stripe. By subscribing you authorise us to charge your payment method on a recurring basis according to the billing cycle you chose. All amounts are in USD unless stated otherwise.
5.3 Refunds
You may cancel at any time. After cancelling you keep access until the end of the current billing period. We do not issue prorated refunds for partial periods. If you believe a charge was made in error, tell us within 30 days.
5.4 Price changes
We may change prices with 30 days' notice. Existing subscribers are told by email before a new price applies to their next cycle.
6. Acceptable use
You agree not to use the Service to:
- Break any applicable law or regulation, or infringe third-party rights
- Distribute malware, viruses or any harmful code
- Try to gain unauthorised access to our systems or to other accounts
- Interfere with or disrupt the integrity or performance of the Service
- Mine cryptocurrency, host torrents or run proxy services
- Send unsolicited bulk communication (spam) through our platform
- Scrape, crawl or harvest data from the Service by automated means without authorisation
- Resell, sublicense or redistribute access to the Service without a written agreement
- Run bots, scripts or automated tools that place excessive load on shared infrastructure
- Store or transmit illegal, defamatory or infringing content
7. Resource monitoring and fair use
Our products run on shared infrastructure. To keep the experience reliable, fast and fair for everyone, we actively monitor resource consumption. This section says how, and what it means for you.
7.1 What we monitor
- Database size - storage used by your tenant databases
- CPU - compute used by your account operations
- Memory - RAM used by your active processes and cached data
- Bandwidth - network traffic your account generates, including API calls and transfers
The monitoring is automated and exists to spot anomalies, prevent abuse and protect the platform from bad actors and bots - not to punish ordinary use.
7.2 What we do with it
- We look at the top 20% of consumers on any monitored metric for review and trend analysis.
- For accounts in the top 1%, we may get in touch to discuss the usage and, where it fits, recommend an Enterprise plan with dedicated resources.
7.3 Enforcement
If an account consistently consumes at a level that degrades the experience for others, we contact you to discuss options (optimization guidance, or an Enterprise plan with dedicated resources). If we cannot reach you, or you do not respond after reasonable attempts, we may throttle, suspend or terminate the account to protect the platform for everyone else. Before terminating we make reasonable efforts to notify you and to give you a chance to export your data.
We are explicit about this because you deserve to know how shared infrastructure is run. The vast majority of accounts are never affected. These rules exist to stop a small number of accounts - through abuse, misconfiguration or bot activity - from degrading the service for everyone.
8. Ownership
8.1 Your data
You keep every right to the data you create, upload or store in the Service. We do not claim ownership of it. We access it only to provide and maintain the Service, as described in the privacy policy.
8.2 Our intellectual property
The Service - software, design, brand, documentation and underlying technology - belongs to Fast Flow Tech and is protected by intellectual property law. Your subscription grants a limited, non-exclusive, non-transferable license to use the Service for its purpose.
8.3 Feedback
If you send suggestions, ideas or feedback about the Service, we may use them with no obligation or payment to you. This does not apply to the product we build for you under section 3, whose code is yours.
9. Availability
We work to keep availability high but do not guarantee uninterrupted access. The Service may be unavailable because of:
- Scheduled maintenance (announced in advance where possible)
- Emergency maintenance or security patching
- Events beyond our reasonable control (force majeure)
Standard plans carry no SLA. Enterprise plans may include uptime commitments negotiated separately.
10. Termination
10.1 By you
You may cancel at any time in your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.
10.2 By us
We may suspend or terminate an account that:
- Breaks these Terms or the acceptable use rules
- Does not pay when due
- Threatens the security or stability of the platform
- Does not respond to resource-usage contact as described in section 7
10.3 What happens next
On termination your right to use the Service ends immediately. We keep your data for 30 days so you can export it. After 30 days it is permanently deleted.
11. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available", with no warranty of any kind, express or implied.
- We do not warrant that the Service will be error-free, secure or uninterrupted.
- We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profit, lost data or lost business opportunity.
- Our total liability for any claim arising from these Terms or the Service is limited to what you paid us in the 12 months before the claim.
12. Indemnity
You agree to hold Fast Flow Tech harmless from claims, losses or damages (including legal fees) arising from your use of the Service, from breaking these Terms, or from infringing third-party rights.
13. Governing law
These Terms are governed by the laws of New Zealand. Disputes arising from these Terms or from the Service are resolved in the courts of New Zealand.
14. Force majeure
Neither party is liable for failure or delay caused by circumstances beyond its reasonable control, including natural disaster, war, terrorism, pandemic, government action, internet or infrastructure outage, or power failure.
15. Changes to these Terms
We may update these Terms. We announce material changes by email and by publishing the new text on this page. Continuing to use the Service after a change means accepting it.
For material changes that affect your rights or obligations we give at least 30 days' notice before they take effect.
16. Severability
If any provision of these Terms is found unenforceable, the rest stays in full force.
